Terms and Conditions

Thank you for booking or prepaying for your remedial massage at Eliza Bennett Elite Massage Therapies ("EBEMT")

These are our terms and conditions:


a. Please read these terms and conditions carefully.
b. All bookings made via Participating Websites or with EBEMT directly are made subject to these terms and conditions and I will be deemed to have accepted these Terms and Conditions once any payment is made in relation to the booking.
c. Bookings may also be governed by and subject to additional terms and conditions which are applied. These terms and conditions may relate to items such as payments, deposits and cancellations and you should confirm the exact conditions directly with Eliza before booking.
d. Any prices, fees, deposit amounts or charges which are specified or referred to in these terms and conditions are in the same currency as the booking to which they relate.


In these Terms and Conditions:
a. “Prepaid Booking” means an appointment which was paid before the appointment time.
b. “Adolescent” has the meaning given in clause 16.
c. “Booking Credit” means credit which may be applied to future service bookings with EBEMT subject to clause 12.
d. “Gift Card” means a gift card bearing the EBEMT brand.
e. “Child” and “Infant” have the meanings given in clause 16.
f. EBEMT meaning Eliza Bennett Elite Massage Therapies
g. “Practitioners” means any Practitioners associated with EBEMT
h. “Participating Website” means EBEMT website and any websites that act as an official partner with Campus Chiropractic & Wellness.
i. “Standard Booking” means a booking at any Practitioner other than a Prepaid Booking.
j. “You” and “Your” mean the person who is making the booking.

How To Book for Services

a. Bookings can be made online via the www.ebemt.com.au website, booking online or contacting either of the following: Phone – 0407 66 0558  E-mail – eliza.bennett@hotmail.com
b. Bookings are subject to the availability and applicable pricing of the booking and some conditions and/exclusions may apply including but not limited to minimum service requirements.
c. Any confirmed price is subject to change if:
i. a payment which is due on a booking is not received by EBEMT by the date the payment is due; or
ii. there is a change in or imposition of a government charge, tax or levy which entitles or necessitates EBEMT changing the price of your booking.
iii. any details relating to your booking are amended, for example your type of service, in which case clause 9 will apply.
e. If the price of a booking is changed under clause 4.d you may pay the new price for your booking or cancel your booking and receive a full refund.
f. If you reasonably believe a written confirmation or invoice which has been provided to you is incorrect, you can request that EBEMT reissue that written confirmation or invoice and you may either pay the amount specified on the reissued written confirmation or invoice by the date which it is specified as being due, or cancel your booking.

Payment, Rates and Charges

a. Payments may be made by Visa, Mastercard, Diners, American Express, Direct Bank Transfer or Australian Dollars.
b. Internet banking payment is available only for prepaid bookings and using an Australian bank account.
c. A surcharge might apply to payments made by Visa, Mastercard, Diners and American Express. The surcharge applied to these cards may vary and is displayed at the time payment for the booking is to be made if applicable. No surcharge will be applied to payment made using Australian Dollars or internet banking.
d. EBEMT accepts no responsibility for monies paid by you to any agent until cleared funds are received in the bank account of EBEMT.

Final Payment

a. For Prepaid Bookings, a non-refundable payment of the entire amount payable per service must be received immediately at the time of booking to confirm your booking. For non Prepaid bookings, full payment is to be made at the time of the appointment.
b. If any deposit or final payment is not received by the due date, EBEMT reserves the right to cancel the booking and any monies paid by you in relation to your booking will be forfeited to EBEMT
c. Once final payment of your booking has been made confirmation of that payment and your booking will be sent to you via email to the email you provided at the time you made the booking.
d. If you arrive late to you scheduled appointment time then time of your treatment will be reduced and you will still be charged the initial appointment cost.


a. To the extent permitted by law any amount paid by you to EBEMT for your booking is non-refundable unless stated otherwise in these Terms and Conditions.
b. The balance of any monies paid by you after any applicable fees or other amount you owe to EBEMT has been deducted will be held by EBEMT as Booking Credit which subject to clause 12 may be applied to any future bookings you make with EBEMT.


a. All amendments are subject to the availability and applicable pricing of the relevant Practitioner at the time the amendment is requested.
b. Amendments for Prepaid Bookings to another day may be requested up to 24 hours prior to your scheduled appointment time.
c. If amendments are requested outside the time frames specified in clause 9.b. you may be charged a 50% cancellation fee in addition to the cost of your amended booking and any reduction in the amount which is payable by you in such case will be at EBEMT
d. Amendments may be requested via a Participating Website or via our clinic reception service in person or by calling +61 2 93518099.
e. If the rate which applies to an amended booking is greater than the rate which applied to the original booking, you must pay the difference along with any amendment fee in full at the time the amendment is approved.


a. If a booking is cancelled any non-refundable payment which you have paid will not be refunded and additional cancellation charges may apply under this clause 10.
b. Before 24 hours of your scheduled appointment: a 50% cancellation fee will apply and you will be required to pay to EBEMT. 100% of the full amount of your booking if you cancel on the day or do not show to your booked appointment to EBEMT.
c. For Prepaid Bookings, if you cancel your booking the full amount of your non-refundable booking payment paid under clause 6.b will be retained by EBEMT as a cancellation fee.
d. Where applicable the balance of any monies paid by you after any applicable cancellation fee has been deducted will be held by EBEMT as Booking Credit which subject to clause 12 may be applied to any future bookings you make with EBEMT.

No-Shows or Terminations

a. If you do not show up for your booking or terminate your booking early after you have commenced your appointment you will be charged a 100% cancellation fee and will be required to pay to EBEMT the full amount immediately less any amount which you have already paid.

Booking Credit

a. If you are issued with Booking Credit to be applied to future appointments with EBEMT such credit will be valid for six months from the day the booking is cancelled.
b. Booking Credit may only be used to pay for bookings at Participating Practitioners located within the same clinic as the cancelled or refunded booking which generated the Booking Credits.
c. Booking Credit may only be used to pay for the appointment or fees such as cancellations fees and may not be used for items such as products not included in the appointment.
d. To redeem Booking Credit you must make your booking via EBEMT.
e. Any service to be fully or partly paid for using Booking Credit must be booked and paid for in full prior to the expiry of the 6 month validity period.
f. Any Booking Credit not redeemed at the expiry of the 6 month validity date will be forfeited in its entirety to EBEMT.

Appointment Check In

a. Standard check-in time is by the time of the appointment. I is asked that you arrive 5 minutes prior your appointment to fill out a form if you are a new client. If you arrive late to you scheduled appointment time then time of your treatment will be reduced and you will still be charged the initial appointment cost. In this case Clause 11 is engaged.
b. You will be considered checked in at the time you present yourself to our staff in the clinic


a. Standard check-out time is done by finalising your payment


Customers are requested to wear a form of underwear that is appropriate to receiving treatment.

Fitness and health

a. Customers are required to complete a Client Record Form and fully inform the Company of any questions contained therein as voluntarily update this information at each subsequent visit, whether prompted to do so or not.
b. Customers must notify the Company of any circumstances affecting their health which for which Treatment may be counter-indicated or for which the Customer has not saught their Doctor’s prior written consent.
c. The Company reserves the right to refuse treatment to any Customer if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the provision of our Services.

Child Policy

a. For the purposes of this clause “Adolescent” means a person aged between 13 and 18 years; “Child” or “Children” means a person or persons aged between 2 years and 12 years; “Infant” means a person under the age of 2 years; and “Adult” means a person aged over 18 years. All ages will be determined from the date at which the appointment is to occur.
b. Children and Infants are to be accompanied by their parent(s), step parent(s), guardians or other adult who has parental rights and responsibilities for their appointments.
c. We do not provide creche or child care / child minding services for Children and Infants.
d. Adolescents are to be accompanied by their parents or guardians at their initial consultation and any diagnostic / report of findings appointments.
e. Client forms must be signed by their parent(s), step parent(s), guardians when the client is under the age of 18years old.


Whilst care is taken to ensure that the description of services of the EBEMT is accurate, these are continually being changed, upgraded, and on occasion taken out of service and if any feature is essential to you in choosing a particular service, it is your responsibility to confirm with the Practitioner prior to making your booking that the feature will be available during your appointment.
To the extent permitted by law EBEMT is not liable for omissions, errors or changes to the features and services at the clinic, whether temporary or permanent.
Features listed may not apply to all services.

Special Requests

Whilst EBEMT attempts to satisfy all special requests, EBEMT does not guarantee that special requests can be accommodated.

Maps and Images

Map images, if shown, are for general information and may not necessarily reflect actual routings, locations or services provided.

Gift Vouchers

a. Gift Vouchers are not refundable or redeemable for cash.
b. Gift Vouchers are valid for 6 months from the date of issue.
c. Additional values cannot be added to an existing Gift Voucher; however, additional Gift Vouchers can be purchased.
d. A surcharge may apply if Gift Vouchers are purchased using a credit or debit card.
e. Gift Vouchers are to be treated like cash and if they are defaced, mutilated, altered, lost or stolen they will not be replaced, refunded or redeemed.
f. EBEMT does not accept any responsibility for lost or stolen Gift Vouchers.
g. Gift Vouchers are issued in Australian dollars (AUD) and:
i. the value nominated on the Gift Voucher may only be used to fully or partially pay for bookings for services;
ii. bookings using Gift Vouchers must be made in person, over the phone or via email in accordance with clause 4.

Unaccompanied Minors

a. All bookings under the age of 13 must be accompanied by a responsible adult such as a parent, step-parent, guardian or other adult who has parental rights and responsibilities for the under 18 year old guest.
b. If a guest is found to be a person under the age of 13 who is not accompanied by a responsible adult EBEMT may immediately cancel the booking and fees may apply depending on the time frame under this clause.

Third Party Products and Services

a. All third party coupons, vouchers, receipts and tickets are issued subject to the terms and conditions specified by those third parties.
b. Campus Chiropractic & Wellness does not warrant the accuracy of any information, statements or representations made by third parties

Release, indemnity and proportionate liability

a. To the extent permitted by the law, you agree to release, indemnify and hold harmless, to EBEMT and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and agents against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking with the relevant Practitioner except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arose out of, was caused by, attributable to or resulted from EBEMT negligence, wrongful act/omission or breach of these terms and conditions.
b. To the extent permitted by law the aggregate of EBEMT liability to you is limited to an amount not exceeding the amount paid by you for your booking.
c. Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.

Consumer Law

a. To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on EBEMT are excluded under these Terms and Conditions.
b. Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits EBEMT to limit its liability, then EBEMT liability is limited to:
i. in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
ii. in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.

Events Beyond Control

a. EBEMTis not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.
b. All documents, observance of laws and government regulations are your responsibility.

Use of Information

a. You consent and authorise EBEMT and the relevant Practitioner to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.
b. You consent to information which you have provided to EBEMT or the relevant Practitioner as part of your booking being used by EBEMT, the relevant Practitioner or any of their related bodies corporate for the purpose of informing you about offers and promotions which relate to EBEMT, EBEMT related bodies corporate or Practitioners.
c. EBEMT will not provide or disclose any information you have provided to EBEMT or the relevant Practitioner to any person other than a related body corporate without your prior written consent.
d. Upon request by you and to the extent permitted or required by law, EBEMT will provide you with access to and/or the ability to correct your personal information however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking.


a. The Terms and Conditions are governed by and will be construed in accordance with the laws of the State of Queensland, Australia.
b. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
